The Need-to-Know About Security Deposits


Do you know what it takes to get your deposit back? When are deposits due? What can be deducted? Read on to learn more!


What is a security deposit?

  • Security deposits are the landlord's way of holding renters accountable for any damage that might occur during tenancy - this does not include general wear and tear!

  • The maximum amount for a Boston security deposit is one month's rent. It can be less than that, but one month's rent is typical, and is a refundable fee that is paid upon move-in.

  • Deposits can only be withheld for these three reasons:

  1. Unpaid rent

  2. Repair of damages beyond normal wear and tear

  3. Cleaning

How can I get my money back?

If you and your roommates have kept your apartment in good shape and paid your rent on time, you are entitled to receive your full money back. However, if there are damages or you haven't paid your rent in full, your landlord is allowed to keep all or a portion of this deposit.


  • When you move in, make sure to take pictures of all the rooms.

  • Document any damages using the Apartment Condition Statement and send to your landlord within 15 days of move-in!

  • After moving out, take pictures of the rooms and any possible damages. Schedule a walk-through with your landlord to explain damages or resolve any issues to make sure you will be getting the full amount back.

  • Security deposits are to be returned within 30 days of moving out. If your landlord has not returned your deposit within this timeframe, write a formal demand letter or contact our office for assistance!

  • If your landlord does withhold all or a portion of your deposit, they must provide an itemized receipt of any damages and the cost to repair them.

  • If you disagree with your landlord, have a conversation with them first and see if you can work out the problem. If the issue still remains, you can send a formal demand letter.
