On August 3, 2021, the Biden Administration extended the federal ban of evictions for renters in counties “with a heightened level of community transmission” of COVID-19. The extension lasts until October 3, 2021, and affects all of Massachusetts except for Franklin and Hampshire counties.
When the pandemic started in March 2020, Massachusetts quickly enacted the strongest eviction ban in the country, essentially shutting down the housing courts and only allowing emergency evictions. Afterward, in October 2020, the Center for Disease Control and Prevention (CDC) enacted its moratorium nationwide to help prevent the spread of COVID-19 by reducing homelessness.
The CDC’s original moratorium ended on Saturday, August 1 but they acted quickly to extend it a couple of days later, although it may face some legal issues. When the Supreme Court originally heard cases against the moratorium, they had originally declined to overturn it, stating that it would be over within 30 days anyways. The CDC is hoping to avoid further legal issues by applying the eviction ban only to certain areas, which is within their authority to protect public health.
